Some good links; Robert Chesney reveals that Andrew Sullivan and Scott Horton are not exactly accurate–to say the least–in their analysis of the Ninth Circuit’s recent decision in Mohamed v. Jeppesen Dataplan. And Jack Goldsmith reveals the extent to which the Obama Administration’s counterterrorism policies resemble those of the Bush Administration (change we can believe in!), and the degree to which members of the Administration have mischaracterized Bush Administration counterterrorism policies (demonstrating the Obama Administration’s typical adherence to facts).
