Conservative Judicial Activism?

We were asked whether there really is such a thing as “judicial activism” over at the Arena, and whether conservatives–per this Ross Douthat column–are as guilty of practicing judicial activism as liberals are. I have my doubts concerning Douthat’s thesis, though I have no doubt whatsoever that Douthat is the perfect “conservative” columnist for the New York Times. He is, after all, very good at beating up on the conservative movement, thus allowing liberals to say things like “even the conservative Ross Douthat thinks that conservatives are full of fertilizer when it comes to Issue [fill in the blank here].”
